Аннотация:This article will argue that penalty clauses are covered by the CISG and many courts, tribunals, and commentaries have taken far too narrow a view. An examination of the general principles, as laid down within the CISG, will lead to the conclusion that penalty clauses are within the ambit of the CISG.
