Аннотация:В статье осуществляется поэлементный юридический анализ состава преступления, предусмотренного статьей 243.4 УК РФ. Особое внимание уделяется толкованию объекта и предмета этого преступления. В результате уяснения всех признаков состава преступления автор «очерчивает круг» уголовно-правового запрета, установленного статьей 243.4 УК РФ, выявляет проблемы и предлагает пути совершенствования анализируемой статьи. Выводы статьи могут быть использованы для дальнейшего исследования соотношения статьи 243.4 УК РФ с составами других преступлений.
The article provides an element-by-element legal analysis of the corpus delicti provided for by Article 243.4 of the Criminal Code of the Russian Federation. Special attention is paid to the interpretation of the object and subject of this crime. As a result of clarifying all the signs of the corpus delicti, the author «outlines the scope» of the criminal law prohibition established by Article 243.4 of the Criminal Code of the Russian Federation, identifies problems and suggests ways to improve the analyzed article. The conclusions made by the author can be used for further study of the correlation of the Article 243.4 of the Criminal Code of the Russian Federation with the elements of the other crimes.
