Аннотация:В статье рассматривается вопрос о назначении наказания через призму особого порядка судебного разбирательства, в частности с прицелом на изучение характеристик личности. Анализируется юридическая доктрина, законодательство, в частности нормы, регулирующие назначение наказания в особом порядке, а также проводится их соотношение с правоприменительной практикой.
The paper aims to identify the problems of the criteria for choosing the type and size of the criminal punishment, to describe the current mechanism for the adoption of such a decision by judges and to formulate a theoretical problem related to the lack of a clear legislative regulation of this issue. The special procedure for the trial (Chapter 40 of the RF Code of Criminal Procedure) is the model for describing this mechanism since in its “pure” form it is nothing more than the selection, imposition and justification of the convict's punishment. For the empirical basis of the research, the authors used legal techniques and methods of social sciences, interviewing in particular. It is in-depth interviews that made it possible to determine the basic theses of the empirical study of the presented material. Respondents were practicing judges with at least 10 years of experience as a federal judge, who regularly review criminal cases and face the practice of applying a special procedure for litigation. In addition to personal communication with the judges, the authors analyse judicial practice both in conjunction with the results of interviewing, and apart from them. The theoretical basis was works of various procedure law experts that discuss certain aspects of the issue under consideration, as well as issues of criminal proceedings and criminal procedure proving at the stage of punishment imposition. In addition to the above, the authors pay great attention to the analysis of court documents and criminal and criminal procedure legislation. Based on the results of the study, the authors identify an urgent problem in criminal punishment imposition that consists in the absence of a single and clear criterion for its selection. They point to gaps in law enforcement that are associated not only with the indicated problem, but also with practical differences in approaches to punishment imposition in different judges and lack of justification of their decisions in sentences, which does not give an understanding of the reasons for the choice made. They also show the need for a legislative regulation of this issue.
