Аннотация:В статье рассматривается прокурорский надзор в досудебном производстве по уголовным делам как эффективный способ выявления и устранения следственных ошибок. Делается обоснованный вывод не только о необходимости расширения надзорных полномочий прокурора, но приданию функции процессуального руководства за предварительным следствием полноценного характера. В результате исследования сделаны конкретные законодательные предложения, принятие которых позволит минимизировать допущение следственных ошибок.
The aim of this study is to develop a modern concept of the prosecutor's supervision and procedural management of preliminary investigation through the prism of investigative errors in criminal procedure activities, to describe its structure and content. The methodological basis is the dialectical method of scientific cognition of social and legal phenomena in their interconnection and interdependence, combined with other general scientific and special methods of cognition: formal-logical, system-structural, historical-legal, comparative-legal, statistical, etc. The paper uses the results of theoretical research in the field of criminal procedure law, statistical data on the prosecutor's office and preliminary investigation of the all-Russian and regional levels for 2011-2016, data of interviewing and surveying of law enforcement officers (judges, prosecutors, heads of investigative bodies, investigators (inquirers), lawyers), including data obtained by the method of covert interviewing and expert survey in Krasnoyarsk Krai, the Republics of Khakassia and Buryatia. In the same regions, criminal cases and materials in the archives of courts have been studied. As a result of the study, the authors substantiate the model of permanent prosecutor's supervision as the main control and supervisory activity in pre-trial proceedings in a criminal case which provides for a full procedural management of the investigator's activities. As such a manager, the prosecutor must have the power to initiate criminal proceedings, correct the preliminary investigation (cancel illegal and/or unreasonable decisions of the investigator (inquirer), extend the period of the preliminary investigation, etc.), resolve complaints of participants in criminal proceedings and interested persons, issue formal demands for the elimination of violations of the law, make conclusions when the court exercises judicial control at pre-trial stages, express consent as a guarantor of legality for the conduct of procedural actions that encroach on the constitutional rights and freedoms of man and citizen, decide in necessary cases on the specific body called upon to carry out a full, comprehensive and objective investigation in a criminal case in accordance with the requirements of the law and the rules of investigation, return the criminal case to the investigator and the inquirer for additional investigation, etc.; powers to finally incriminate criminal charges against a person, to conclude a pre-trial cooperation agreement with them and to stop criminal prosecution.
