Аннотация:The article is devoted to the problem of taking into account the legal positions of the ECHR by the national judicial authorities. The author analyzes the practice of the English law and order for the application of decisions of the European Court of Human Rights by national courts, as well as the practice of the Russian legal system. The problem of qualifying legal positions is discussed, taking into account the decisions of the Constitutional Court of the Russian Federation. The importance of the legal position of the ECHR for the system of national law and law enforcement is assessed. The author expresses a number of proposals for the formulation of current legislation.
